These Terms of Service ("Terms") form a legally binding agreement between you (“you” or “your”) and Gürkan Soykan (“we,” “us,” or “our”), governing your access to and use of FlashCardify, our mobile application (“App”), and associated services and features (collectively referred to as the “Service”).
PLEASE READ THESE TERMS CAREFULLY. They include important information about your rights and obligations, limitations of liability, and disclaimers. These Terms also outline provisions regarding subscription renewals and dispute resolution through arbitration.
By downloading, installing, or using FlashCardify, you confirm that you agree to these Terms. If you do not accept them, you must discontinue using the Service immediately.

1. Privacy
Your use of FlashCardify is governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the Service, you acknowledge and agree to our Privacy Policy.
2. Eligibility
- General Eligibility: You must be at least 16 years old to use FlashCardify. Users under 18 may only use the Service under the supervision of a parent or guardian who agrees to these Terms.
- EEA, UK, and Switzerland Users: If you are located in these regions, you must be at least 18 years old to use the Service. If you become aware of any underage usage, please notify us at gsoykan@sabanciuniv.edu.
3. Changes to the Terms and Service
We may modify these Terms or the Service at any time for various reasons, such as adding features, complying with laws, or addressing technical updates. Updated Terms will be posted with the "Effective Date," and we will notify you of significant changes via in-app notifications or email.
Continued use of the Service constitutes your acceptance of the updated Terms.
4. Subscriptions and Payments
Subscription Plans
FlashCardify offers three subscription options:
- Weekly Plan: Includes 5 flashcard generations.
- Monthly Plan: Includes 25 flashcard generations.
- Annual Plan: Includes 500 flashcard generations.
Subscription fees are automatically charged at the end of each billing period unless canceled. Manage or cancel subscriptions through your App Store or Google Play account settings.
Refunds
Uninstalling the app does not cancel your subscription, and fees for active periods are non-refundable.
5. Prohibited Conduct
You agree not to:
- Use FlashCardify for illegal or harmful purposes.
- Upload inappropriate or offensive content.
- Reverse-engineer or tamper with the app.
- Use automated methods (e.g., bots) to access the Service.
Violations may result in account termination.
6. Generative AI Features
FlashCardify leverages AI to generate flashcards from user inputs such as text, PDFs, and video links. By using these features, you grant us a license to process your inputs solely to improve our Service. You retain ownership of your content.
You agree not to use the AI features to:
- Generate harmful, illegal, or offensive content.
- Infringe on third-party rights.
7. Intellectual Property
We retain all ownership rights to FlashCardify, including its content and technologies. You are granted a limited, non-transferable license to use the app for personal, non-commercial purposes.
8. Disclaimer of Warranties
FlashCardify is provided "as is" without any warranties, including those of merchantability or fitness for a particular purpose. We do not guarantee uninterrupted or error-free service.
9. Limitation of Liability
Our liability is limited to the amount you paid for the Service or $10, whichever is greater. We are not responsible for indirect or consequential damages arising from your use of FlashCardify.
10. Termination
You may terminate your use of FlashCardify at any time by canceling your subscription and deleting the app. We may terminate your access if you violate these Terms.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of Turkey, excluding its conflict of laws rules. Any disputes arising from or related to these Terms will be resolved through binding arbitration in Istanbul, Turkey, conducted in English (or Turkish, if both parties agree).
If arbitration is not applicable or enforceable, disputes may be resolved in the courts of Istanbul, Turkey, unless mandatory law provides otherwise.
12. Miscellaneous
These Terms constitute the entire agreement between you and us regarding FlashCardify. If any provision is deemed unenforceable, the remaining provisions will remain in effect.
